
The school district’s gender-identity policy, which excludes parents from decisions about their children’s gender transitions, is accused of violating parents’ constitutional rights to direct their children’s upbringing, education, and health care. Attorneys from the Child & Parental Rights Campaign and Alliance Defending Freedom (ADF) represent parents Stephen Foote and Marissa Silvestri, who requested Supreme Court review in July.

Despite this, school officials secretly facilitated the girl’s “social transition” to “genderqueer,” using a male name and nonbinary pronouns like fae/faerae or xe/xem. They provided pro-LGBT resources, encouraged her to reject her parents’ care plan, and allowed her to use boys’ bathrooms—all while concealing these actions by using her birth name in communications with her parents.
“Parents—not the government—have the fundamental right to direct the upbringing, education, and health care of their children,” said ADF Senior Counsel John Bursch. “The Ludlow School Committee insists it knows better than parents, undermining centuries of tradition, case law, and common sense. We are thankful for the advocates urging the Supreme Court to affirm parents’ constitutional protections.”

“Ludlow’s actions should trigger alarm bells,” stated a brief led by Montana, West Virginia, and Florida. “The First Circuit greenlit public intrusions into the parent-child relationship, empowering schools to seize control.” Another brief from 38 Pennsylvania school board directors emphasized, “Parents are the adults who care the most about their child… Interference with that core relationship separates a child from unique wisdom, care, and understanding.”
The 1st Circuit Court of Appeals ruled against the parents in February, prompting ADF to join as co-counsel for the Supreme Court petition.
