Represented by the Alliance Defending Freedom (ADF), the families—Joe and Serena Wailes, Bret and Susanne Roller, and Rob and Jade Perlman—argue that the school district is violating their fundamental right to direct the upbringing of their children, as well as their children’s right to bodily privacy.
According to court filings, the parents contend that JCPS officials intentionally withhold information regarding rooming arrangements. The brief alleges that while the district assures parents that “girls will be roomed together” and “boys will be roomed together,” officials do not disclose that they have redefined those terms to align with a student’s self-asserted gender identity rather than biological sex.

“Parents, not government bureaucrats, have the right and responsibility to direct the upbringing and education of their children, and that includes making informed decisions to protect their children’s privacy,” said Kate Anderson, ADF Senior Counsel and director of the ADF Center for Parental Rights.
Anderson emphasized the conflict between the district’s stated goals and the families’ religious liberties. “Jefferson County Public Schools claims to ‘freely grant accommodations to all,’ yet they will not offer equal accommodations to religious students to access educational opportunities without sacrificing their bodily privacy,” she said.

The Perlman family, citing past sexual harassment their daughter allegedly suffered at a district middle school, joined the suit stating they cannot risk the district placing her in a room with a biological male.
The families are asking the 10th Circuit to reverse the lower court’s decision and enjoin the district from requiring students to share sleeping quarters or shower facilities with students of the opposite sex. They argue the current policy forces a choice between foregoing educational opportunities or compromising their religious values and privacy.
Jefferson County Public Schools has not issued a specific comment on the Wednesday filing, though the district has previously defended its policies as necessary to support transgender and gender-nonconforming students.
