Pizza delivery driver ambushed by four males intent on robbing him — so he pulls out his gun and shoots three of them

A North Carolina pizza delivery driver was bringing an order to an east Charlotte apartment complex just before midnight Monday when an ill-tempered quartet approached him.

No, they didn’t want a large pizza with extra pepperoni — police said they had robbery on their minds, ambushed the driver, and pointed what looked like a rifle at his head, WSOC-TV reported.

What happened next?

Like countless others are doing these days, the pizza delivery driver had armed himself for just such an occasion. And he pulled out his gun, and fired it at the robbers, the station said.

With that the suspects ran off, and the driver called 911, police told WSOC.

What happened to the suspects?

Officers quickly caught three of the suspects near a laundromat, the station said, adding that two of them were taken to a hospital with gunshot wounds and are expected to be OK. Police told WSOC a third suspect was detained and was not shot.

More than an hour later, a fourth suspect was dropped off at a hospital with a gunshot wound to the chest, the station said, adding that he’s also expected to be OK.

Who are the suspects?

Here’s the police rundown of the suspects, WSOC said, adding that all four are male — and were or will be charged with robbery with a dangerous weapon and conspiracy to commit robbery with a dangerous weapon:

  • A 15-year-old was charged after he was treated at the hospital.
  • A 16-year-old was charged as a juvenile due to the state’s Raise the Age law that went into effect last month. It says that 16 and 17 year olds who commit crimes in North Carolina no longer will be charged automatically in the adult criminal justice system — and that in 2017, lawmakers raised the age of juvenile jurisdiction for nonviolent crimes to age 18, according to the state’s Department of Public Safety.
  • Toybyus Banks, 18, was being treated for a gunshot wound at a hospital but will be charged upon his release.
  • Nemiah McInnis, 20, was charged after he was released from the hospital. Police told WSOC that McInnis has several previous charges on his record, including motor vehicle theft, possession of a stolen vehicle, larceny from motor vehicle — and that he has a “history” of resisting police.

Anything else?

Police found the supposed rifle the suspects used during the robbery and determined that it was a toy rifle painted to look like a real gun, the station said.

The pizza delivery driver wasn’t hurt in the incident, authorities told WSOC, adding no indication was made regarding whether the driver will face charges.
